I think NSC is still following the EAD processing date unlike TSC which approves EAD application during "receipting".

My wife and my documents were delivered on June 6th and receipt date June 14th. My AP was approved on July 20th. However, my wife's is still pending though there are two date update since mine is approved - July 22nd and 27th. Anyone has the same situation?

My I-140 was submitted to USCIS in June, 2006 and got approved in August, 2006 and my employer has received the approval notice. I am checking the case status online but it is still showing up that my case is in pending till date. One of my friends is also in the same situation, his I-140 got approved recently and he received approval notice copy from attroney but the case did not update on the USCIS web site as approved. When I called USCIS, they told me that this needs to be reported by my lawyer and not me. When I talked to my attroney on this, she told me that we don't need to worry about this as the approval notice is available with us. But if the case update showing up correctly, atleast I could show that as a proof for my priority date portability if I switch the employer. Does anyone experienced the same problem and appreciate the suggestion as to how this can be corrected. Thanks in advance.

I got my I-140 Approved (EB3 - Jan 2004) with Company A. Can i use the approval notice and get my H1B extended for 3 years from a different company ? Please advice as this will help me a lot.

Are you allowed to work on H1b for your primary employer and EAD for your own LLC. My wife applied for 485 as a derivative applicant. She has her H1b valid until next year. When she resumed work last year after her pregnancy she submitted her EAD card to the employer's attorney. So far she was under the impression she is now working on EAD. Suddenly the attorney calls her and tells her that they are recommending and H1 extension.
Which is fine if it is possible but in the meantime she has started her own LLC which is likely to generate revenue soon. Is it valid for her to do so while resuming H1b status? Will it be construed that she is working for her own LLC using her EAD.

I am married with an American Citizen. His petition has been approved. My problem is that I cant change my status because my J1 visa was subject to the 2 years home country. I came as an Au Pair or Child Care Provider in 2007. I have been subject to that rule because the Skill List from 1997, which is not even in any field in my country El Salvador in the Skill List. That is why my application is hereby denied.
I dont know what i should do, because just I have 15 days to make a motions to reopen o pay a waiver and re-file my application all over again.
Please I need help is anyone can advice me in this. I really need it.

Your post raises so many questions it is hard to know where to start.
The obvious one is if you do not have an employer, how have you got an H1B visa since it is the employer who petitions for it?
Second thought, where are you right now? Still in your own country or the USA?
In response to your question about a green card. If you are going to follow the employment based route, by definition, you are going to need an employer to get this process rolling. Starting with PERM labor certification.

Hello,
I was born in Canada and moved to the U.S. when I was 8 years old. I was naturalized when I was 18 (4 years ago). I heard that when naturalized in the U.S, my Canadian citizenship was not lost (I never filed any paperwork with the Canadian government stating I wanted to give up my Canadian citizenship either). Is this true?
If so, can I apply for a Canadian passport? Should I do this? Are there any responsibilities/problems/repercussions that could occur if I do this?

Hi All,
I am in the fourth year of mu H1b, and I need to start my GC process. My current employer is a consulting firm which provides services to a third party main client. My questions are :
a) is this a good time to file for GC given the fact that my company falls under employer-employee relationship memo?
b) I plan to go to India in summer and need to get my stamping. Will the new memo from USCIS affect my stamping? My current h1b expires in sept 2011.
c) If I apply for my GC before going to India in summer, does it affect point b ?

I-140 processing date isn't country specific, but make sure check the date for the center you have applied to - the date varies by center
